How much does it cost?
Your first call with us is always free of charge. We will only charge you once we have undertaken an assignment to assist you. When we accept the assignment, we will agree on a fee level and the principles for charging. If we have appointed an attorney or a legal associate to act as your counsel, public defender, court-appointed counsel or public defender, you will never have to pay us anything for that work. In many cases, you may be entitled to legal aid or use the legal protection provided by your home insurance.
Legal protection
Many people, both individuals and businesses, have legal protection insurance built into their home or business insurance. Legal protection insurance covers part of the cost of legal assistance, after deducting the deductible which is usually 20-25% of the total cost. The amount of the deductible varies between different insurance companies.
Not all disputes are covered by insurance companies’ legal protection insurance. Examples of disputes that are normally covered by legal protection insurance are custody, housing and visitation disputes, but also other disputes such as damages and claims.
In custody or other child-related disputes where the parties have recently cohabited, insurance companies may grant legal protection provided that the dispute has arisen no earlier than one year after the separation or divorce.
Another common condition for claiming legal protection under home insurance is that the policyholder must have had home insurance for at least two consecutive years. You do not need to have had the insurance with the same insurance company, but you do need to be able to show that you have been insured continuously for two years.
Other types of insurance besides home insurance may also include legal protection, e.g. trade union insurance and business insurance.
We at Advokatlaget will be happy to help you apply for legal protection and assist you with your contacts with the insurance company.
Legal aid
If you don’t have a home insurance or if legal protection is not available, you can often apply for state legal aid to a court or to the legal aid authority. Legal aid means that the State helps you to pay part of the costs of your legal representation. When a decision is made on your application for legal aid, a decision will be made at the same time on how much of the costs you will have to pay. The percentage you have to pay is determined by your financial circumstances and varies between 2% and 40%. If your annual income does not exceed SEK 260 000, you may be entitled to legal aid.
At Advokatlaget, we are happy to help you find out whether you could be entitled to legal aid and help you with your legal aid application.
Anyone who is dissatisfied with an invoice can turn to the Consumer Disputes Board of the Swedish Bar Association.
