Asylum means that a person seeks protection in a country other than their home country. If you want to apply for asylum in Sweden, you must submit an application for asylum to the Swedish Migration Agency. As an asylum seeker, you are often entitled to have a public counsel appointed for you to safeguard your rights in the asylum process. A public counsel is usually an attorney or a legal associate. The costs of the public counsel remain with the State.

Detention means that a person who does not have permission to stay in the country and is to be refused entry or deported is taken into custody and held pending an investigation into the person’s right to stay in the country. When you are detained, you are deprived of your liberty and may only stay in a locked ward.
A person who has been detained for more than three days has the right to have a public counsel appointed to defend their rights in the detention process. A public counsel is usually an attorney or a legal associate. The costs of the public counsel remain with the State.
